Nautic Watersport reserves the right to amend these terms and conditions at any time. The customer acknowledges that Nautic Watersport is authorized to amend these terms and conditions. In the event of substantive changes to the terms and conditions, all Nautic Watersport users will be notified by email, and the amended terms and conditions will be sent to you.
1 Definitions
1.1 The general terms and conditions are determined by Nautic Watersport.
1.2 These terms and conditions apply to every quotation, offer and agreement between the seller (Nautic Watersport) and the buyer (customer).
1.3 Deviations from these conditions are only valid if agreed in writing between the seller (Nautic Watersport) and the buyer (customer).
1.4 These general terms and conditions (Nautic Watersport terms and conditions) also apply when work is carried out by third parties.
1.5 The customer: a counterparty who is a natural person.
1.6 In the event of a dispute between Nautic Watersport and the customer, Dutch law shall apply at all times.
1.7 All delivered goods remain the property of Nautic Watersport until the customer has fully met his payment obligations arising from the agreement.
2 Regarding the products
2.1 All prices are subject to typographical errors.
2.2 All prices are net cash, without discounts and inclusive of applicable VAT, unless otherwise agreed in writing.
2.3 All prices exclude shipping costs.
2.4 The items offered are depicted and/or described as clearly as possible on the website. In written offers, too, the items possess the properties stated in the offer.
2.5 Installation and commissioning of the items are not included in the price. Disposal fees for white and brown goods are also not included.
2.6 The Nautic Watersport website clearly states what the customer owes when ordering, including 21% VAT and shipping costs, and what the customer's rights and obligations are if they accept the offer.
2.7 If any of the cost price components increase after the order has been confirmed, Nautic Watersport has the right to pass on the increase(s) to the customer. Nautic Watersport is at all times entitled to adjust its prices based on circumstances that, had they been known to Nautic Watersport at the time the agreement was concluded, would have resulted in different pricing.
3 Order and delivery returns
3.1 Nautic Watersport will only deliver after receipt of your payment. Regardless of the payment method chosen by the customer when placing the order, Nautic Watersport reserves the right not to deliver orders and/or to fulfill them at a later date.
3.2 The customer must comply with all return conditions. Return shipping costs are the customer's responsibility. After receipt of the return and approval by Nautic Watersport regarding the condition of the products, the customer will be refunded within one to two weeks, excluding return shipping costs.
The customer has the right to cancel their order up to 14 days after receipt without giving any reason. After cancellation, the customer has another 14 days to return the product. The customer will then be credited with the full order amount, including shipping costs. Only the return costs from your home to the online store are at your own expense. If the customer exercises their right of withdrawal, the product must be returned to Nautic Watersport with all accessories and – if reasonably possible – in its original condition and packaging. To exercise this right, the customer can contact Nautic Watersport at info@Nauticwatersport.nl. Nautic Watersport will then refund the order amount due within 14 days of the customer's notification of return, provided the product has already been returned in good order. The returned items must not be used or damaged. After the 14-day period has expired, the customer is deemed to have approved the goods/invoice.
3.3 The customer must comply with all return conditions. Return shipping costs are the customer's responsibility. After receipt of the return and approval by Nautic Watersport regarding the condition of the products, the customer will be refunded within one to two weeks.
3.4 Amounts already paid for items that are returned or advance payments made by the customer, based on conditions set by Nautic Watersport, will be refunded if the sale does not take place.
3.5 Orders are shipped by mail or courier. You will be notified of the shipping time by email. Shipping costs are paid by the customer. These costs are stated on the order/invoice you received by email.
3.6 During transport of the goods, the risk of damage and/or loss lies with Nautic Watersport. After the items have been received by the customer, the risk of damage and loss passes to the customer. If items are lost or damaged, the customer agrees to cooperate in any way with an investigation. If the customer refuses to cooperate, Nautic Watersport is entitled to claim the full amount of the ordered items.
3.7 Nautic Watersport undertakes to deliver ordered goods within 3 to 4 business days after receipt of payment from the customer. If delivery is delayed—whether due to temporary out-of-stock, other reasons, or if an order cannot be fulfilled or can only be partially fulfilled—the customer will be notified within 1 to 2 business days.
3.8 If a delivery deadline is not met, the customer must notify Nautic Watersport in writing.
4 Warranty
4.1 Nautic Watersport guarantees the soundness and/or usability of the products it supplies. Nautic Watersport's warranty is in accordance with the warranty applied by the supplier to the goods supplied to Nautic Watersport by its suppliers. If the manufacturer makes further exclusions in the manufacturer's warranty certificate, these limitations will be accepted by Nautic Watersport. The date stated on the invoice serves as the effective date of the warranty.
4.2 The customer is obligated to thoroughly inspect the delivered goods for defects immediately upon delivery and, if any are found, to notify Nautic Watersport in writing immediately. If the customer does not notify Nautic Watersport of any defects that could have been detected upon thorough inspection within 14 days of the invoice date, the customer is deemed to have accepted the condition in which the goods were delivered, and any right to make a complaint shall lapse.
4.3 Any defect in an item that arises during normal use will be replaced free of charge by Nautic Watersport upon written request from the customer within the warranty period of one month after purchase. If the customer legitimately requests a replacement, Nautic Watersport is also entitled to refund the purchase price.
4.4 In the event of visible defects, the customer must return the item to Nautic Watersport at the expense of Nautic Watersport within the 14-day inspection period, and state the defect.
4.5 In the event of hidden defects, or in the event of visible defects after the 14-day inspection period, any complaint must be reported within 14 days, but no later than one month after the invoice date. The customer must include a written description of the discovered defects. If the customer does not request repair or replacement in writing, Nautic Watersport will decide whether the item will be replaced.
4.6 If the customer returns items on their own initiative, they are responsible for the shipping costs. Nautic Watersport is in no way liable for damage incurred during transport.
4.7 Nautic Watersport is not liable for any damage suffered by the customer or a third party as a result of using an item supplied by Nautic Watersport, unless the customer can demonstrate that the damage was caused by intent or gross negligence on the part of Nautic Watersport. Direct or indirect costs or damage to the customer or a third party caused by the non-use of a defective item are not eligible for compensation, unless the customer can demonstrate that the costs or damage were caused by intent or gross negligence on the part of Nautic Watersport.
4.8 If and to the extent Nautic Watersport is liable for insufficient or incorrect performance of the work assigned to it or for improper fulfillment of its contractual or legal obligations, its liability will be limited to a maximum of the total amount of the (partial) order it accepted, excluding VAT. Any claims by the Client must be submitted within eight business days of completion. Failing this, all claims on that basis will be forfeited.
4.9 Defects due to incorrect handling are not covered by the warranty.
5 Your data
5.1 By placing an order, data is stored in Nautic Watersport's personal data database. Upon written request, the customer will be provided with access to the stored personal data. Corrections provided by the customer will be incorporated into the database, unless the corrections prove to be incorrect.
5.2 However, Nautic Watersport cannot guarantee the security of the Internet and the possibility of interception or disruption of data transmitted by the customer using the correct customer identification, and cannot be held liable in any way for this by the Client.
5.2 Nautic Watersport will not provide data to third parties without legal reasons, or outside the purpose of its personal registration, which could compromise the customer's privacy.
6 Other provisions
6.1 Nautic Watersport cannot accept any liability for the consequences of printing errors on the website or other forms of media.
6.2 By placing an order, each customer declares that he or she unreservedly agrees to the above terms and conditions of sale.
6.3 Suspension and termination In the event of an impediment to full or partial performance of the agreement due to a non-attributable failure to perform, Nautic Watersport is entitled to suspend performance of the agreement without judicial intervention, without Nautic Watersport being liable for any damages.
6.4 A non-attributable failure to perform includes, but is not limited to, the failure of suppliers/subcontractors to meet any performance obligations they may have towards Nautic Watersport, on whom Nautic Watersport depends for the performance of the outsourced work.
6.5 Force majeure situations include, but are not limited to: restrictive government measures of any kind, strikes, seizures, interruptions to the ability to work on the customer's order.
6.6 If the performance of the agreement is suspended for more than three months due to a non-attributable failure in performance, Nautic Watersport is entitled to terminate the agreement, insofar as it has not been performed, without judicial intervention by giving written notice to the Client and to claim payment for the part of the agreement that has been performed, without being liable to pay any damages to the client.
6.7 We recommend that you first submit your complaints to us by emailing info@Nauticwatersport.nl. If this does not lead to a solution, you can submit your dispute for mediation through the Stichting WebwinkelKeur (Web Shop Quality Mark Foundation). As of February 15, 2016, consumers in the EU can also submit complaints via the European Commission's ODR platform. This ODR platform can be found at http://ec.europa.eu/odr. If your complaint is not yet being handled elsewhere, you are free to file your complaint via the European Union platform.
